      This is the last will and testament of me John Harris of West End in the Hamlet of Hailey in the parish of Witney and County of Oxford, spinner. I give and devise unto John Early the Younger of West End in Witney aforesaid, Blanket Manufacturer and Charles Early of Witney aforesaid Blanket Manufacturer, sons of Mr. John Early of Newland in the parish of Coggs in the County of Oxford, Blanket Manufacturer and to their heirs and assigns All that my Copyhold Mesuage or Dwelling House amd premises situate in West End in Hailey aforesaid wherein I now reside and which was devised to me by the will of my father Samuel Harris, decceased, to hold the same unto the said John Early and Charles Early, their heirs and assigns for ever upon the trusts hereinafter mentioned concerning the same that is to say upon trust to permit and suffer my wife Sarah Harris to reside in and occupy the said messuage and premises or in case she should prefer it to pay her or allow her to receive the rents and profits of the same for and during the term of her natural life she keeping the same premises in good and tenantable repair and insured against loss or damage by fire and from and after the decease of my said wife then I will direct and declare that my said trustees or the survivor of them, his successors or administrators or other the trustees or trustee for the time being of this my will do and shall as soon as is in their judgement and discretion proper and judicious sell and dispose of the said copyhold messuage or dwelling house and premises either by public sale or private contract and I empower the said trustees or trustee it it shall be deemed expedient to purchase in the said premises at any auction or auctions and also to enter into special stipulations realtive to the title to be deduced to the said premises or any other matter connected with the sale thereof and also to rescind or vary the terms of any contract or contracts for sale that may have been entered into and I direct that the money to arise by such sale or sales shall become and constitute part of my general residuary personal estate and until such sale shall be made I direct that the rents and profits of my said Messuage and premises shall be paid to the person or persons for the time being entitled to the income of my said residuary personal estate And I further direct and declare that upon the sale or sales hereinbefore directed and upon any and every other occasion the receipt or receipts of the Trustees or Trustee for the time being of this my Will shall be a good and

      sufficient discharge or good and sufficient discharges for so much of such purchase money or other monies paid to the said Trustees or Trustee as in such receipt or receipts shall be expressed to have been received and that the purchaser or purchasers or other person or persons so paying the same shall not afterwards be obliged to see the application thereof or be answereable or accountable for any loss or misapplication of the same or any part thereof And I give and bequeath all and singular my household goods and furniture, books, pictures, plate, linen, china, and glass which shall be in and about my Dwelling house at the time of my decease to the said John Early the Younger and Charles Early their executors and administrators upon trust that my said Trustees shall immediately after my decease cause an inventory to be made and taken of the said furniture and effects and upon further trust to permit and suffer my said wife Sarah Harris to have, use, and enjoy the said furniture and effects during her life and after her decease to dispose of the same as is hereinafter directed And I hereby give and bequeath all the residue and remainder of my personal estate and effects of what nature or kind soever and wheresoever unto the said John Early the Younger, and Charles Early upon trust that they or the survivor of them his executors and administrators or other the trustees or trustee for the time being of this my will shall and so do with all convenient speed after my decease sell, dispose of and convert into ready money such part of the residue of my personal estate as shall not at the time of my decease consist of or be invested upon any share of the public stocks or funds or other government securities of Great Britian and Ireland or upon real securities in England and receive and recover and get in all debts, credits, and sums of money except as aforesiad as shall be due and owing to me at the time of my decease from any person or persons whomsoever And upon further trust that the said trustees or trustee shall and do lay out and invest the monies which shall arise by such sale or sales of the residue of my said personal estate and to be received, got in, and produced as aforesaid in their or his own names or name in the public stocks or funds or other government securities of Great Britian and Ireland or upon real securities in England at interest and shall and do from time to time at their or his discretion call in, receive, sell, transfer and dispose of all or any part of the said last mentioned stocks, funds and securities and also such part of the residue

      of my personal estate as shall at the time of my decease consist of such stocks, funds or securities and shall and do lay out and invest the monies to arise by such callings in sales, transfers and dispositions in the names or name of the said Trustees or Trustee for the time being upon new or other stocks, funds or securities of the like nature and so to be varied and transposed from time to time as often as occasion shall require And upon further trust that the said Trustees and Trustee shall and do stand possessed of and invested in the said residue of my personal estate and the stocks, funds and securities in or upon which the same shall from time to time be invested and the interest, dividends and yearly produce thereof upon the trusts and for the intents and purposes hereinafter expressed concerning the same that is to say Upon trust from time to time to pay to or authorize and empower, permit and suffer my said wife to receive the dividends and interest thereof to and for her own use and benefit during her life and from and after her decease upon trust to sell the said household goods and furniture and other effects which I have hereinbefore bequeathed to my said Trustees in trust to permit my said wife to use and enjoy the same during her life and after deducting all costs and expenses of and attending the sales of my said dwelling house and household goods and effects from the purchase monies received for the same respectively to pay, share and divide the whole of the net produce of the said household goods and effects and a moiety or half part of my said residuary personal estate unto and equally between my brother Thomas Harris of West End in Witney in the said County of Oxford, shoemaker, my sister Elizabeth Thomas, the wife of Henry Thomas of London, coachplater, the two children of my late sister Kezia Biggers deceased namely Mary Ann Biggers now residing with me and Joseph Biggers of London, tailor, who are to take one share equally between them and the two children of my late sister Mary Lea namely Kezia Hume, now in America, and Elizabeth Rolf, wife of Richard Rolf, shopman, who are also to take one share equally between them or such and so many of them as shall be living at the time of my decease and the issue then living of any or either of them who shall be then deceased as either before or after my decease shall being a male or males attain the age of twenty one years or being a female or females, attain that age or marry such issue to take of more than one in a course of distribution according to the stocks

And upon further trust to pay, share and divide the remaining moiety or half part of the produce of my said household goods and effects and residuary personal estate unto and between Joseph Godwin of Surinbrook in the said County of Oxford, laborer, Charles Godwin of the same place, laborer, Martin James the wife of George James of Quiting in the County of Gloucester, laborer, Mary James the widow of Isaac James of the same place, laborer, Janes Jones the wife of Stephen Jones of Stow on the Wold in the said County of Gloucester, stone mason, Phoebe Adams the widow of ____ Adams late of Kemble in the County of Wilts, Smith and Rebecca Goodwin the wife of John Goodwin of Sutton under Bailes in the County of Warwick, laborer, the brothers and sisters of my said wife or such and so many of them as shall be living at the time of my decease and the issue then living of any or either of them then deceased as either before or after my decease shall being male or males attain the age of twenty one years or being a female or females attain that age or marry such issue to take if more than one in a course of distribution according to the stocks and not to the number of individuals Provided Also and I hereby declare that in Case the said John Early and Charles Early or either of them shall die in my lifetime or shall renounce the execution of the trusts hereby created or in case the said Trustees or any Trustee or Trustees to be appointed under this present provision shall die or shall be absent from the United Kngdom for the space of six calendar months at one time or shall otherwise become unwilling or unable to act in the aforesaid trusts then and so often as the same shall happen it shall be lawful for my said wife during her life and after her decease for the surviving or continuing Trustee or if there shall be no such Trustee then for the retiring or renouncing Trustee for the time being or if there be no such last mentioned Trustee then for the executors or administrators of the last deceased Trustee to nominate and appoint any fit person or persons to supply the place or places of the Trustee or Trustees respectively so dying residing abroad or becoming unwilling or unable to act as aforesaid And that immediately after every such appointment the said trust estates monies and effects, stocks, funds or securities shall be conveyed or transferred in such manner that the same may vest in such new Trustee or Trustees jointly with the surviving or continuing Trustee or Trustees or in such new Trustee or Trustees solely as the case may require and such new Trustee or Trustees shall have and be capable of excercising all the powers and authorities whatsoever hereinbefore

      contained in the same manner to all intents and purposes as if he or they had been appointed a trustee or trustees by this my will. Provided Also that the trustees for the time being of this my will shalnot be answerable or accountable for the acts, deeds, receipts oe defaults of each other but each of them for his or her acts, deeds, neglects and defaults only, Nevertheless I declare that this exemption from legal responsibility shall not abridge or affect the right of any trustee to enquire into the transactions of his Co-Trustee or Co-Trustees And that the said trustees of this my will respectively shall not be answereable or accountable for any loss which may happen to the said premises unless the same shall happen by thier own wilful neglects or defaults respectively And that each of the said Executors and TRustees for the time being shall and may reimburse himself and hersolf and allow to his and her Co trustee all such costs, charges and expenses as they respectively shall or may incur in or about the execution of the trusts of this my will. I hereby nominate and appoint the said John Early the Younger and Charles Early joint executors of this my will and revoke all other wills by me at any time heretofore made and declare this only to be my last will and testament. In witness whereof I hav hereunto set my hand this twenty eighth day of October Anno Domini One thousand eight hundred and fifty six.

      You Swear that the contents of the Affidavit hereunto annexed, and to which you have subscribed your names, are true, to the best of your knowledge and belief; and that the Paper Writing marked "A" also hereunto annexed, doth in it contain the true original Last Will and Testament of John Harris, late of West End in the Hamlet of Hailey in the parish of Witney in the County of Oxford, deceased, as far as you know or believe; that the said John Harris deaprted this life on or about the 24th day of October, 1857 that you are the executors named in his said will; that you will duly execute and perform the same, and pay his debts and legacies, as far forth as his goods, chattels, and credits will thereto extend, and the Law bind you; and that you will make, or cause to be made, a true and perfect inventory of all and singular the goods, chattels, and credits of the said deceased, which have or shall come to your hands, possession, or knowledge, and exhibit the same into the Registry of the Archdeacon of Oxford and pass a just and true account of your Executorship thereupon, when thereto lawfully required; You swear, that the goods, chattels, and credits of thesaid Deceased are under the value of one hundred Pounds.       This is the last Will and Testament of me Samuel Harris of West End in the Hamlet of Hailey in the parish of Witney in the County of Oxford, Baker, made this twenty sixth day of February one thousand eight hundred and forty six as follows: I give and devise all that my copyhold and messuage or tenement with the Bake house, outbuildings, yard, garden, fixtures and appurtenances belonging situate in West End aforesaid and now in my own occupation unto my son John Harris, his heirs and assigns for ever he paying thereout in sterling money within six calendar months after my decease one third of the value of the said messuage or tenement and premises unto my son Thomas and one other third of such value to my daughter Elizabeth Thomas such value to be ascertaned by any competent person to be appointed by my trustees hereinafter named but should my said son John refuse to take the said premises on such terms or neglect to pay the said two thirds of the amount of such value within the time hereinafter limited for payment thereof then I direct my trustees hereinafter named to sell such messuage or tenement and premises either by public auction or private contract to any person or persons willing to become the purchaser or purchasers therof for the best price that can be obtained with full power to enter into such contracts, covenants, agreements, assurances and conveyances as may be necessary for assuring the same premises to the purchaser or purchasers thereof and I declare that the receipt and receipts of my said trustees or trustee for the time being for the purchase money shall effectually discharge ther person or persons paying the same from being answerable or accountable for the misapplication or nonapplication thereof or from being obliged to see to the application thereof or any part thereof and I declare that my said trustees or trustee shall stand and be posesed of and interestedin the money to arise from such sale and of and in the rents and profits of the said premises until the same shall be disposed of upon trust to divide the same unto and equally between my said sons John and Thomas and my daughter Elizabeth Thomas share and share alike. As to all and sigular my money, securities

      for money, book, and other debts, household furniture, plate, linen, china, and all other my personal estate and effects whatsover and wheresover and of what nature or kind soever I give and bequeath the same to my friends John Early the elder of Newland in the parish of Coggs in the said County, Blanket Manufacturer, and Edward Hyde of Witney aforesaid, Surgoen, upon trust to divide such part thereof as does not consist of money or securities or is not of a pecuniary nature unto and equally between my said sons John and Thomas and my said daughter Elizabeth Thomas and as to the money and securities for money, book, debts and pecuniary estate upon trust in the first place to pay thereout all my just debts, funeral and testamentary expences and then the following legacies that is to say ten pounds each to Joseph and Mary Ann Biggers, children of my late daughter Kezia Biggers deceased and ten pounds each to Kezia Lea and Elizabeth Rolf, children of my late daughter Mary Lea deceased and then upon trust to divide the clear residue unto and equally between my said sons John and Thomas and my said daughter Elizabeth Thomas And I direct that any money payable under this my will to my said daughter Elizabeth Thomas shall be paid into her own proper hands in order that the same may be enjoyed and disposed of by her as her separate property entirely free from the control debts or engagements of her present or any future husband and for such moneys her receipt shall be the only sufficient discharge to the persons having to pay the same. I appoint the said John Early and Edward Hyde joint trustees and executors of this my Will and I declare that the one shall not be answereable for the other of them but each for himself only and for his own respective acts, deeds, receipts, neglects, and willful defaults only. In Witness whereof I the said Samuel Harris the Testator have to this my last Will and Testament contained in two sheets of paper set my hand the day and year first above written.
