Page 359 The Last Will and Testament of Jacob Fraley Be it remembered, That heretofore, to wit: on the Seventeenth day of March in the year of our Lord, on thousand eight hundred and Eighty John Fraley of Cape Vincent, Jefferson County, New York, one of the legatees named in the last Will and Testament of Jacob Fraley, late of the town of Cape Vincent in the County of Jefferson deceased, appeared in open Court, before the Surrogate of the County of Jefferson and made application to have said last will and testament which relates to both Real and Personal Estate, proved; and on such application the said Surrogate did ascertain by satisfactory evidence who were the heirs at law and next of kin of the said testator, and their respective residences, and they are as follows viz: said petitioner John Fraley, Peter Fraley and Mary Bardol of Cape Vincent aforesaid, and George Fraley of Rochester, Monroe County, New York, children of said testator, and are all of full age. and said Surrogate did thereupon issue a citation in due form of law, directed to the said heirs at law and next of kin of said testator by their respective names, stating their respective places of residence and requiring them to appear before said Surrogate at his office in the City of Watertown in said County, on the 31st day of March A. D., 1880, to attend to the Probate of said Will. And aftwerwards, to wit: on the 31st day of March A. D., 1880 satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said citation in the mode prescribed by law, and on that day, no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court, afterwards, that the said Surrogate took the proofs of said Will hereinafter set forth said 31st day of March A.D. 1880 and upon this Eighth day of April A. D., 1880, said matter having been duly affirmed & held open to April 8th, 1880 and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said last Will and Testament and proofs, are hereinafter recorded in this book. Page 360 Jacob Fraley Estate Will I, Jacob Fraley of the town of Cape Vincent, in the County of Jefferson and State of New York, being of sound mind and memory, do make, ordain, publish and declare this to be my last will and testament, that is to say; First: After all any lawful debts are paid and discharged, I give, devise and bequeath to my son Peter Fraley all my household property, furniture, and utensils of every kind, name and description whatsoever, also all the stock of every kind, and all the farming tools, implements & utensils, chattels and personal property of name, kind and nature and description whatsoever. Second: All my land and real estate I give, devise and bequeath to my four children, George Fraley, Mary Bardol, John Fraley and Peter Fraley, to be divided equally between them, share and share alike, except that one hundred and ninety ($190) dolars heretofore paid to George, by John & Peter shall be deducted from the share of my said son George, and paid to & divided equally between my said sons John and Peter. Likewise, I make, constitute and appoint Jacob Berringer, and Peter Garlack, of Cape Vincent, N.Y. to be executors of this my last will & testament, hereby Page 361 revoking all former wills by me made. In witness whereof, I have hereunto subscribed my name and affixed my seal the 11th day of September A. D. 1876 Jacob Frohlig (L.L.) The above instrument consisting of one sheet was at the date thereof subscribed by Jacob Fraley in the presence of us, and each of us; he at the time of making such subscription acknowledged that he made the same, and declared the said instrument so subscribed by him to be his last Will & Testament. In the matter of proving the Will of the real and personal estate of Jacob Fraley deceased. County of Jefferson ss. Frank Wiley of the town of Cape Vincent in said County, being first duly sworn, deposeth and saith, that on the 11th day of September 1876 at Cape Vincent aforesaid, he saw Jacob Fraley deceased, subscribe the instrument now shown to this deponent, and which purports to be the last will and testament of Jacob Fraley late of the town of Cape Vincent in said County, deceased, bearing the date of 11th day of September in the year of our Lord, one thousand eight hundred and Seventy Six, That on the day of the date aforesaid, and at the time of signing the same, he heard the said Jacob Fraley declare the same to be his last will and testament, and that he this deponent, and Ezra D. Hilts the other subscribing witness did then subscribe their names thereto as witnesses at the request and in the presence of the said Jacob Fraley and of each other, that at the time thereof, the said Jacob Fraley was of sound and disposing mind, memory and understanding, of full age, and not under any restraint, and competent to make a will. Mrs. Mary Bardoll, a highly respected lady who resided at 13 Meadow Street, died very suddenly and unexpectedly at her home last evening before medical aid could be summoned. Mrs. Bardoll was a widow, and besides herself, two boarders lived with her. One of them was gone, yesterday, and so was not at the house last evening. The other, whose name is Charles Sitts, and who is employed in the Union Carriage and Gear company's work, returned to Mr. [Mrs.] Bardoll's home about 9. He conversed with her for a few moments, and then went to his room. He did not notice anything strange in Mrs. Bardoll's actions, and in her conversation with him she seemed to be as bright and cheerful as usual, and was looking forward with much pleasure to a sleigh ride soon. About 9:30, the young man went to his room and retired. The room is located on the ground floor. It was nearly 10, when he awoke from a slight slumber and heard Mrs. Bardoll groaning. He hastily arose from his bed, dressed himself and as quickly as possible went to the suffering woman's assistance. After he had reached the sitting room where Mrs. Bardoll was, she took a lamp and went into the kitchen, and it is thought while there she took some peppermint or wintergreen to ease the pain, as the smell of it could be plainly scented afterwards. However, she quickly came back to the sitting room in a more distressed condition, it seemed, than before. She sat down in a chair, and the agonies she suffered can be better imagined than described. The young man aroused the neighbors and then hastened for a physician. He summoned Dr. H. H. Smith, but when he arrived at Mrs. Bardoll's home, the unfortunate woman had expired. Yes, the ship was built in 1829 in Bath, Maine, by W.G. Farrin and owned by Jas. H. McLellan. This information is found in the book A Maritime History of Bath, Maine and the Kennebec River Region by William Avery Baker. There are no photographs of the ship Charles in our collection. Perhaps there may be paintings or drawings of the ship but again, we do not have in our collection. As to your question pertaining to the amount of trips made by Charles to and from Havre, France, this question is still being researched.
